These Terms of Service (“Terms”) govern your access to and use of the ReadGenie mobile application and related services (collectively, the “Service”), operated by Classe.ai / ReadGenie (“ReadGenie,” “we,” “us,” or “our”). By creating an account, downloading, accessing, or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
Parents/Guardians. The Service is intended for use by children only under the supervision of a parent or legal guardian (“Parent”). The Parent is responsible for the child’s use of the Service and for ensuring the Service is used in accordance with these Terms.
Children. Children may use the Service only with Parent consent and under Parent supervision. If you are under the age of majority where you live, you may not create an account yourself.
Account creation. A Parent may be required to create an account to access features. You agree to provide accurate information and keep it up to date.
Account security. You are responsible for maintaining the confidentiality of your login credentials and for all activities under your account. Notify us immediately if you suspect unauthorized access.
Parent responsibility. You are responsible for (a) your child’s activity on the Service, (b) supervising your child’s use, and (c) ensuring that your child does not submit information beyond what is requested by the Service.
The Service provides educational practice tools and feedback intended to support reading and literacy skills. It is not a substitute for professional educational, medical, diagnostic, or therapeutic services. ReadGenie does not provide medical advice or diagnoses. If you have concerns about a child’s learning needs, consult qualified professionals.
Pricing. Some features may be offered for free and others may require payment (“Paid Features”). We may change pricing, features, and availability at any time, subject to applicable law.
App store billing. If Paid Features are purchased through Apple’s App Store or Google Play, payments, renewals, cancellations, and refunds are handled by those platforms and subject to their terms.
Taxes. You are responsible for any applicable taxes associated with purchases, except where we are required to collect them.
License. Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for personal, non-commercial educational purposes.
Acceptable use. You agree not to (and not to allow your child or anyone else to):
• Use the Service in any way that violates laws or regulations.
• Attempt to gain unauthorized access to the Service or other users’ accounts.
• Interfere with or disrupt the Service (e.g., hacking, introducing malware, or probing vulnerabilities).
• Reverse engineer, decompile, or attempt to extract source code except where prohibited by law.
• Copy, modify, distribute, sell, lease, or sublicense the Service or any portion of it.
• Use the Service to create or train competing products, models, or datasets (including through scraping) without our written permission.
• Upload or transmit content that is unlawful, harmful, or infringes others’ rights.
User content. The Service may allow you or your child to submit content (such as audio recordings, reading attempts, or messages) (“User Content”). You retain ownership of your User Content as between you and ReadGenie.
Permission to process. By using the Service, you grant ReadGenie permission to host, store, process, transmit, and analyze User Content to provide, maintain, and improve the Service, generate progress reports, and support features described in our Privacy Policy.
Feedback. If you provide suggestions or feedback, you grant us the right to use it without restriction or compensation.
The Service, including its software, design, text, graphics, logos, audio, and educational content (excluding User Content), is owned by ReadGenie or its licensors and is protected by intellectual property laws. You may not use our trademarks or branding without written permission.
The Service may rely on third-party services (such as cloud hosting, speech analysis, or AI processing) to function. Your use of the Service may therefore involve third-party providers processing data on our behalf as described in our Privacy Policy. We are not responsible for third-party sites or services that are not part of the Service.
Your use of the Service is subject to our Privacy Policy, which explains how we collect, use, and share information. By using the Service, you agree to our Privacy Policy.
By you. You may stop using the Service at any time.
By us. We may suspend or terminate access to the Service (in whole or part) if we reasonably believe: (a) you violated these Terms, (b) your use could harm the Service, other users, or third parties, or (c) we are required to do so by law. We may also discontinue the Service or any features at any time.
Service provided “as is.” The Service is provided on an “AS IS” and “AS AVAILABLE” basis. To the maximum extent permitted by law, we disclaim all warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
No guarantee of outcomes. We do not guarantee that use of the Service will improve reading outcomes, achieve specific results, or be error-free or uninterrupted.
To the maximum extent permitted by law, ReadGenie and its affiliates, founders, employees, contractors, and licensors will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, goodwill, or other intangible losses, arising out of or relating to your use of (or inability to use) the Service.
To the maximum extent permitted by law, our total liability for any claim arising out of or relating to the Service will not exceed the greater of (a) the amount you paid to ReadGenie for the Service in the 12 months before the event giving rise to the claim, or (b) US $100.
Some jurisdictions do not allow certain limitations of liability, so some of the above may not apply to you.
You agree to defend, indemnify, and hold harmless ReadGenie and its affiliates, founders, employees, contractors, and licensors from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising from or related to: (a) your or your child’s use of the Service, (b) your violation of these Terms, or (c) your User Content.
Governing law. These Terms are governed by the laws of the State of Delaware, without regard to conflict-of-law principles, except where your local consumer protection laws require otherwise.
Venue. Except where prohibited by law, you agree that disputes will be brought in the state or federal courts located in Delaware, and you consent to personal jurisdiction there.
Injunctive relief. Nothing prevents either party from seeking injunctive relief in any court of competent jurisdiction for misuse of intellectual property or unauthorized access to the Service.
We may update these Terms from time to time. If changes are significant, we will provide notice through the app and/or via email. Continued use of the Service after the effective date of the updated Terms constitutes acceptance of the updated Terms.
